The Court of Reggio Emilia in Judgment No. 336 of February 18, 2022, acquitted an administrative auxiliary of the crime of abusive access to a computer system: several times through her credentials she had accessed the computer systems of the justice system to check the criminal proceeding of an acquaintance. The conducts were carried out in the aftermath of two relevant decisions of the Supreme Court Joint Sections, the last of which changed the punitive aim of the rule, making punishable conducts that were not punishable before. In fact, while until 2017 no criminal significance was ascribed to the conduct of those who, although authorized to access a computer system, did so for unlawful purposes, as of today this is no longer the case. The defendant could not have foreseen this worsening of the case law development and was acquitted.
