{"id":2043,"date":"2026-05-21T17:55:41","date_gmt":"2026-05-21T15:55:41","guid":{"rendered":"https:\/\/www.studiodalpozzo.net\/pubblicazione-immagini-social-senza-consenso-trattamento-illecito-dati-personali\/"},"modified":"2026-05-21T18:00:37","modified_gmt":"2026-05-21T16:00:37","slug":"the-publication-of-images-on-social-media-without-consent-constitutes-unlawful-data-processing","status":"publish","type":"post","link":"https:\/\/www.studiodalpozzo.net\/en\/the-publication-of-images-on-social-media-without-consent-constitutes-unlawful-data-processing\/","title":{"rendered":"The publication of images on social media without consent constitutes Unlawful Data Processing"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On 16 January, <a href=\"https:\/\/tribunale-pescara.giustizia.it\/\" target=\"_blank\" rel=\"noreferrer noopener\">the Court of Pescara<\/a> filed its judgment on the unlawful data processing, holding that <strong>the publication of images on a public social media platform<\/strong> without the data subject\u2019s consent constitutes a criminal offence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The facts of the case<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The defendant had <strong>livestreamed on Facebook<\/strong>, through her personal account, <strong>video recordings made with her mobile phone<\/strong> of individuals waiting in line at the counter of a public office, without their consent and contrary to the express wishes of the public service operators on duty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She was subsequently committed for trial on charges of unlawful processing of personal data.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The offence of unlawful data processing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The offence of unlawful processing of personal data punishes any person who, for the purpose of obtaining a benefit for themselves or others, or of causing harm to the data subject,<strong> causes prejudice to the latter<\/strong> by acting in breach of the data protection provisions laid down in the Italian Privacy Code.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The offence also extends to <strong>private individuals who disclose sensitive personal data to third parties without the data subject\u2019s consent<\/strong>, even where such data has been acquired only incidentally. Indeed, the prohibition on disclosure applies to all persons who have come into possession of sensitive data, regardless of how such possession was obtained, including accidental acquisition.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Subject matter of the criminal conduct<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The Italian Privacy Code<\/strong> penalises the <strong>unlawful disclosure of data without the data subject\u2019s consent<\/strong>, rather than the mere acquisition of such data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As regards the element of harm, this term must be understood as referring to any legally relevant prejudice, whether pecuniary or non-pecuniary, suffered by the injured party.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The subjective elements of the offence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is required that the perpetrator\u2019s intent be characterised by the further purpose \u2014 alternatively \u2014 of obtaining a benefit (including for the advantage of third parties) or causing harm, although it is not necessary that such purpose be actually achieved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Court\u2019s decision<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Court clarified that, in the present case, the defendant, by disseminating video footage of individuals present in the public offices, <strong>processed the personal data<\/strong> of those individuals without their consent and therefore committed the offence. The livestreaming on a social media platform of the events involving her at that time clearly <strong>infringed the privacy rights<\/strong> of the employees and of all the other individuals filmed during the Facebook live broadcast.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court therefore convicted the defendant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The case concerning the publication of a photograph on a social media platform<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This ruling is consistent with the case law of the Supreme Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In another case, for example, the Italian Supreme Court held that the offence of unlawful processing of personal data may also be committed through<strong> the publication of a single photograph on a public platform <\/strong>without the data subject\u2019s consent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, the Italian Supreme Court established that consent to the use of an image as a <strong>WhatsApp profile<\/strong> picture does not in any way amount to consent to its unrestricted dissemination; the subsequent publication of the same image on a <strong>Facebook group<\/strong>, accessible to a much wider audience and in a derogatory context, constitutes unlawful processing of personal data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that the photograph was visible to WhatsApp contacts is irrelevant: its further dissemination without consent amounts to a separate and serious infringement of the privacy rights of both the person depicted and third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The\u00a0<a href=\"https:\/\/www.studiodalpozzo.net\/en\/\">law firm Dal Pozzo<\/a>\u00a0in Milan provides legal assistance to private individuals, public entities, and businesses, including matters related to to\u00a0<a href=\"https:\/\/www.studiodalpozzo.net\/en\/cybercrimes\/\">cybercrimes<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 16 January, the Court of Pescara filed its judgment on the unlawful data processing, holding that the publication of images on a public social media platform without the data subject\u2019s consent constitutes a criminal offence.
